Three assessment regimes sit inside one trading region
Sunshine Coast Regional Council administers the Sunshine Coast Planning Scheme 2014, gazetted on 2 May 2014 and commenced on 21 May 2014. Council describes it as a living document and advises users to check regularly for amendments. Noosa Shire Council administers the Noosa Plan 2020, adopted in July 2020, whose stated purpose is to guide the growth and development of Noosa Shire through to 2040.
Inside the Maroochydore City Centre, Caloundra South and Halls Creek priority development areas, development assessment sits with Economic Development Queensland under the relevant development scheme or interim land use plan, not with a council planning scheme. So a buyer comparing a cafe in Cotton Tree with a cafe in Noosaville is comparing two planning schemes, two fee registers and two councils’ assessment timeframes, and a buyer looking at a Maroochydore tenancy may be dealing with a third assessment manager three streets from the second.

Noosa held 7,962 businesses in total and the divisions sum to 7,971 because ABS perturbs small cells. Read this table against the Sunshine Coast table above rather than blending the two, because the two councils are structurally different registers.
Your trade waste permit is a Unitywater permit, and it does not transfer
Unitywater is the water and sewerage service provider for the Moreton Bay, Sunshine Coast and Noosa regions. Its published position is that there are no refunds or part refunds on any permit issued, and that permits are not transferable. The process on a change of ownership is set out plainly. The outgoing owner completes and submits the cancellation of trade waste permit form. The incoming owner completes and submits the apply for a trade waste permit form, and is then sent an account for the annual permit fee.
Permits are categorised high risk, medium risk and low risk depending on the level of risk associated with the waste, with a treatment tier structure introduced from 1 July 2023 on the principle that the higher the trade waste impact, the more it costs to treat and the higher the treatment tier. Fees are charged quarterly in arrears.
That reaches a Mooloolaba restaurant, a Noosaville cafe, a Kunda Park engineering shop, a Yandina food manufacturer, a Warana car wash, a Coolum bakery and a Caloundra commercial laundry alike. There is no transfer mechanism to negotiate and no refund of your unexpired fee, so draft it as a condition precedent rather than leaving it to the settlement statement.

Unitywater published fees for 2026-27, excluding GST, charged quarterly in arrears. The $268.00 trade waste search is the cheapest piece of due diligence in the transaction, because it establishes whether a permit exists at all and at what category.
Noosa treats a takeover as a new application, with 30 business days’ notice
Noosa Shire Council states that a food business licence application is required for a new licensee for an existing business, that is, a takeover. Applications must be lodged at least 30 business days before the day you plan to operate. Applications cannot be accepted until they are completed in full with the relevant documents attached and payment made. Council emails a payment link to the applicant and assessment proceeds only after full and correct payment has been received.
Thirty business days is roughly six calendar weeks. A Hastings Street or Gympie Terrace food business contract that allows two weeks between signing and settlement has a problem before it starts.
Sunshine Coast Regional Council issues food licences under the Food Act 2006 (Qld) for fixed premises, mobile food vehicles, market stalls and temporary food businesses, home based food businesses and water carriers. For a fixed food business the process runs in four steps: check the other approvals needed, submit a food business plan application with kitchen floor plans and elevations, complete the licence application and nominate a food safety supervisor, then pass a final inspection. The plan assessment fee for 2026-27 is $797.00 and council advises applying approximately 20 days out from when you intend to start. Council’s pages for existing businesses do not cover ownership changes, so a separate change of ownership or transfer fee could not be verified for this research. Ask council for it before it goes into a contract.
Footpath dining does not carry across on the Sunshine Coast
Sunshine Coast Council states that you will be required to apply for a new footpath trading application when you take over the business. Approval is required where a business provides tables or chairs on public land for outdoor dining, or where an area is made available to the public to consume food or drinks.
Applications require layout plans at a suitable scale such as 1:100, coloured photographs of the furniture and the site frontage, proof of the food business licence, and a public liability insurance certificate for a minimum of $20 million. Council also warns that expanding the size of your footpath dining area could change current planning and building approvals.
On the Mooloolaba Esplanade, Ocean Street at Maroochydore, Bulcock Street at Caloundra or Duporth Avenue, the footpath area can be a large share of trading capacity. It does not come with the business automatically. Council does not publish the application fee, the permit duration or the specific conditions, so none are quoted here. Separately, council’s low use and low impact permits for activities on council land are valid to 31 July each year.
Your approval may be narrower than the way you actually trade
Sunshine Coast Council states that development approval may also be required for changes to how a premises is used, such as adding new services, increasing patron numbers, changes to operating hours, signage or parking demand, and that different zones allow different types of business activities. Council publishes free tools to check this before contract: Development.i for applications and approvals, Site Report for zoning, and an AI Development Assistant Tool for preliminary guidance. Council recommends using its Development Advice Services before committing to premises.
The practical trap in a sale is drift. Extended hours, added seating, added patrons, added signage or added services can each be a change that required approval and did not get one. That is a seller’s problem to find first, not a buyer’s solicitor’s problem to find in week three of due diligence.
Five devolved environmental activities, and the one to watch here is boats
Both councils administer the same five devolved prescribed environmentally relevant activities under the Environmental Protection Act 1994 (Qld): ERA 6 asphalt manufacturing above 1,000 tonnes a year, ERA 12 plastic product manufacturing at 50 tonnes or more a year or 5 tonnes or more of foam, composite or rigid fibre reinforced plastics, ERA 19 metal forming at 10,000 tonnes or more a year, ERA 38 surface coating using 1 to 100 tonnes of coating materials a year, and ERA 49 boat maintenance or repair. Sunshine Coast Council states that complete applications are processed within 20 days.
ERA 49 is the one to watch in this region. Mooloolaba, Kawana, Noosaville and the Noosa River carry marine service businesses, and a buyer of a boat repair, antifoul or marine engineering business needs to establish which environmental authority exists, who holds it and how it is dealt with at settlement. Under the general Queensland framework you can apply to transfer an environmental authority for a prescribed activity, but you cannot transfer one for a resource activity.
Noosa maps its flood overlay to a 2100 event, which is more conservative than a present day map
Noosa Shire Council’s flood overlay identifies areas potentially affected by flooding during a modelled event with a 1 per cent annual exceedance probability for the year 2100, mapped as overlay maps OM-FH-1 through OM-FH-14 in the Noosa Plan 2020, with interactive maps through Intramaps Noosa. Property owners can request a Flood Search Certificate giving the latest flood level information for a specific property, minimum finished floor requirements for new habitable rooms and flood velocity data. Council states the maps are indicative only and should not be used for real estate or property investment decisions. Noosa also publishes coastal hazard mapping.
Sunshine Coast Regional Council publishes flood mapping products and flood information for emergency preparedness and land use planning, and has completed a storm tide study dated 2024. Property specific information comes through council’s certificates and searches.
For a tenancy in Noosaville, Tewantin, Cooroy or along the Noosa River, that overlay drives insurance, make good, fitout floor levels and lender appetite. Pull the certificate before you sign, not after.
Build the contract backwards from four published timeframes
Sunshine Coast Council currently advises that file retrieval and search requests may take 15 to 20 business days, and that search applications will not be accepted without payment. Its property search suite covers rates and valuation, business licensing and health, flooding, building, plumbing and development records, stormwater as constructed searches, building searches, file retrievals and planning and development certificates.
Put the four together. Noosa food licence, 30 business days. Sunshine Coast searches, 15 to 20 business days. Unitywater, a fresh application and a fresh annual fee of up to $3,968.00 for a Category 2 permit in 2026-27. Sunshine Coast footpath dining, a new application on takeover. A contract in this region that does not allow for those is a contract that will be extended.

Noosa Shire Council does not publish fee amounts for food business licences, footpath dining, short stay letting approvals or environmentally relevant activities on the pages tested, so no Noosa fees are quoted on this page.
Short stay letting is separately regulated in Noosa
Noosa Shire Council regulates short stay letting and home hosted accommodation as named permit categories, alongside food business licensing, health licensing, environmentally relevant activities, filming on council land, and advertising devices and signage. Council publishes a short term accommodation guide covering approval requirements, exclusions including party houses, and short term accommodation in the low, medium and high density residential zones, the rural residential zone, the rural zone and the tourist accommodation zone, under council’s Short Stay Letting and Home Hosted Accommodation Local Law.
That matters to a sale twice over. It reaches any accommodation, management rights or property services business directly. It also reaches labour supply across the shire, because housing let short term is housing not available to staff, and Noosa runs the highest median house price in the region on the lowest median employee income.
The Nambour Special Entertainment Precinct is an asset attached to an address
Nambour carries a regulatory feature no other town here has. The Nambour Special Entertainment Precinct is only the second precinct of its kind in Queensland. Entertainment uses inside it, including restaurants, bars, theatres and nightclubs that may include live or amplified music, are exempt from the amplified music noise requirements of the Queensland Government’s liquor licensing laws.
Council regulates amplified music inside the precinct through Local Law 1 (Administration) 2011. A local law approval is not required for the operation of a premises if it does not emit amplified music above Lceq 65db, measured at any point 1 metre external to the premises. A yearly licence fee applies to the approval, and council offers 50 per cent off development applications as an incentive for new businesses in the precinct. For a live music venue, a bar or a late trading restaurant, that exemption is a commercial advantage attached to a location, and it exists in Nambour and not in Maroochydore, Mooloolaba or Noosa. Name it in the information memorandum.
What Noosa’s development controls actually produce, stated as outcomes
You will hear that Noosa has a population cap. The Noosa Plan 2020 landing page describes the scheme’s purpose as guiding the growth and development of Noosa Shire through to 2040 and states no numerical population limit, and the ePlan strategic framework could not be retrieved for this research. So no population cap is asserted here as council policy.
What is verified is the outcome. Noosa’s estimated resident population grew 16.1 per cent between 2011 and 2024, from 51,038 to 59,274, against 40.4 per cent for the Sunshine Coast over the same thirteen years. Its business base grew 0.6 per cent in the year to 30 June 2025. It recorded 488 registered deaths against 388 registered births in 2023, a natural decrease of 100 people, so the population grows only because migration exceeds that. In calendar 2024 it approved 366 dwelling units, of which 209 were dwellings other than houses and only 157 were houses. There is no priority development area and no state development area anywhere in the shire, and the whole shire sits inside an 87,000 hectare UNESCO biosphere reserve designated on 20 September 2007.
For a seller that is the argument, and it runs both ways. Scarcity of supply is real and evidenced. So is a growth rate a buyer will not underwrite at Sunshine Coast assumptions. Give a buyer the shire figures rather than the regional ones, because a buyer who checks will find them anyway.
