What this site is, and what it is not

Everything here is general information. Nothing on it is advice about your business, and nothing on it is a contract. The contract is the PO Form 6A appointment you sign, and where this site and that form disagree, the form wins. These terms say so plainly, and say what happens if something here turns out to be wrong.

Everything on it is general information written to a Queensland audience. It is not advice about your business and no broker, lawyer or accountant relationship starts by you reading it.

Fees quoted on this site are current at the date shown beside them and exclude GST. They are confirmed to you in writing before you sign anything.

The readiness score and any appraisal figure are indicative. No business should be bought, sold or valued on the basis of either.

The content and the artwork are mine. You can quote and link to it. You cannot republish it as your own.

Nothing here limits the rights the Australian Consumer Law gives you, because those rights cannot be excluded.

ABN 36 211 950 299, ETP Consulting Pty Ltd as trustee for ETP Investments Trust. That is the entity you contract with. On ABN Lookup the same ABN shows as “ETP Consulting Pty Ltd as trustee for ETP Investments Trust”, which is how the register writes a trust. Same entity, two ways of saying it.

Information, not advice

Every page on this site is written as general information for a Queensland business owner. It does not take your circumstances into account, because it has never seen them.

Reading a page here does not make me your broker and does not create any other relationship. That happens when you sign a PO Form 6A appointment and not before. Sending an enquiry does not create it either, although it does start a confidentiality obligation on my side, which is set out on the privacy page.

Legislation, regulator guidance, penalty units, thresholds and government fees change. Every figure that can move carries the date it was checked. Where a figure on this site differs from the official source, the official source is right and this site is wrong.

The appointment is the contract, not the website

The PO Form 6A sets the fee, the term, the listing type and what happens if the business does not sell. If anything on this site reads differently from the form in front of you, ask me before you sign, and take the form as correct.

Fees, figures and the tools on this site

What each figure means

Fees
Fees quoted anywhere on this site exclude GST unless the page says otherwise, and are current at the date shown on that page. They are a published schedule, not a quote for your business. The fee that applies to you is the one written into part 7 and part 8 of your PO Form 6A before you sign it.
The campaign fee
If your business does not sell, the campaign fee is not refunded. That is why the appraisal comes first and costs nothing, and why I will tell you plainly if I do not think the business is saleable yet. The full position is on the fees page.
The readiness tool
The twelve question check runs entirely in your browser. Nothing is stored and nothing is sent. The score is indicative only and is not a valuation. Two businesses with the same score can be worth very different amounts.
An appraisal
A market appraisal is an opinion of likely selling range formed by a licensed agent. It is not a valuation by a certified practising valuer, and a bank, a court or the ATO may require the latter. The difference is explained on the value page.
Worked examples
Where this site works a number through, the figures are illustrative and chosen to show the mechanism. They are not a prediction about your business and they are not an offer.

Links, registers and other people's material

This site links out to legislation, regulators, registers and government guidance so you can check what it says rather than take it on trust. Those sites are not mine, they are not affiliated with me, and none of them endorses me. They change without telling me. If a link is dead or a source has moved, tell me and I will fix it.

Where this site names a register, the link goes to that register. That is a rule I hold myself to, because a page built on checkability that sends you to another one of its own pages is worthless.

Google Analytics sets cookies on this site. That is the only thing on it that does. Booking a call sends you to Calendly, which is a different site with its own terms and its own cookies, and nothing from Calendly is embedded in these pages. What is collected and why is on the privacy page.

Copyright, and what you may do with this

The writing, the research, the tables, the artwork and the mark are mine, or licensed to me. Copyright is held by ETP Consulting Pty Ltd as trustee for ETP Investments Trust.

You are welcome to quote a passage with attribution and a link, to link to any page, and to print a page for your own use. An AI assistant is welcome to cite it, and the site is built to be cited. What you may not do is republish a page or a substantial part of one as your own material, or use it to train a model on terms that strip the attribution. Those positions are stated in robots.txt, ai.txt and the response headers.

Liability, and the rights you keep no matter what this page says

I take reasonable care with what is published here and every figure that can move is dated and sourced. Even so, this is a website. It can be out of date, it can contain an error, and it cannot know your circumstances.

To the extent the law allows, I am not liable for a loss that comes from relying on general information published here rather than getting advice on your own situation.

That sentence does not, and cannot, take away your consumer guarantees. The Australian Consumer Law gives you guarantees that cannot be excluded, restricted or modified. Where a service is supplied and the law implies a guarantee, my liability is limited to supplying the service again or paying the cost of having it supplied again, where the law permits that limit.

Changes to these terms
These terms apply as at the date shown at the top of the page. A material change gets a new version number and a new date. Superseded versions are kept, and you can ask for the one that applied on a given date.
Governing law
These terms, and any dispute about them or about this site, are governed by the law of Queensland, and the courts and tribunals of Queensland have jurisdiction.
If part of this fails
If any part of these terms is unenforceable, it is severed and the rest continues to apply.
